Welcome to Blue Check HVAC Systems (“Company,” “we,” “our,” or “us”). By accessing our website, requesting a quote, scheduling an appointment, or using our services, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our website or services.

1. Services

Blue Check HVAC Systems provides residential HVAC services, including but not limited to:

  • Furnace maintenance and repair
  • Air conditioner maintenance and repair
  • Heating and cooling diagnostics
  • HVAC installations and replacements
  • Water heater services
  • Humidifier installation and maintenance
  • Preventative maintenance
  • Indoor air quality solutions
  • Emergency HVAC services (subject to availability)

Service availability may vary depending on location, scheduling, weather conditions, and technician availability.

2. Estimates and Pricing

Quotes and estimates are provided based on the information available at the time.

Final pricing may change if:

  • Additional issues are discovered during diagnosis
  • Additional labour or materials are required
  • The scope of work changes at the customer's request
  • Hidden defects or unforeseen conditions are encountered

We will explain any additional charges and obtain your approval before proceeding with additional work whenever reasonably possible.

3. Appointments

Customers are responsible for providing accurate contact information and ensuring reasonable access to the property at the scheduled appointment time.

If a technician is unable to access the property or the appointment cannot proceed due to circumstances beyond our control, a service or trip charge may apply.

4. Cancellations and Rescheduling

Appointments may be cancelled or rescheduled by contacting us as early as possible.

Blue Check HVAC Systems reserves the right to charge a cancellation fee for appointments cancelled with little or no notice or when technicians have already been dispatched.

5. Payment

Payment is due upon completion of services unless otherwise agreed in writing.

We may accept various payment methods, including debit cards, credit cards, electronic transfers, cash, or other approved payment methods.

Late or unpaid invoices may be subject to collection efforts and any costs permitted under applicable law.

6. Warranties

Manufacturer warranties apply only to products supplied by the manufacturer and are subject to the manufacturer's terms and conditions.

Where applicable, Blue Check HVAC Systems may provide a workmanship warranty covering installation or repair services. The duration and scope of any workmanship warranty will be communicated to the customer before or at the time of service.

Warranty coverage does not include damage resulting from:

  • Misuse or neglect
  • Improper operation
  • Unauthorized repairs or modifications
  • Acts of nature
  • Lack of recommended maintenance
  • Existing defects unrelated to our work

7. Customer Responsibilities

Customers agree to:

  • Provide safe access to the work area
  • Keep children and pets away from active work areas
  • Provide accurate information regarding HVAC equipment and previous repairs
  • Follow manufacturer operating instructions after service
  • Notify us promptly if issues arise following service

8. Limitation of Liability

To the fullest extent permitted by law, Blue Check HVAC Systems shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our services or website.

Our total liability shall not exceed the amount paid by the customer for the specific service giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

9. Emergency Services

Emergency service availability cannot be guaranteed at all times and may be affected by weather, technician availability, road conditions, or other unforeseen circumstances.

Emergency service rates may differ from standard service rates.

10. Website Use

You agree to use our website only for lawful purposes.

You agree not to:

  • Attempt unauthorized access to our systems
  • Upload malicious software or harmful code
  • Interfere with website functionality
  • Use our website for fraudulent purposes

11. Intellectual Property

All content on our website, including logos, graphics, text, photographs, videos, and branding, is the property of Blue Check HVAC Systems unless otherwise stated.

No content may be copied, reproduced, or distributed without prior written permission.

12. Third-Party Services

Our website may include links to third-party websites or services. We are not responsible for their content, policies, or practices.

13. Privacy

These Terms of Service shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

Any disputes arising from these Terms or our services shall be resolved in the courts of Ontario unless otherwise required by applicable law.

We reserve the right to modify these Terms of Service at any time. Updated versions will be posted on our website with the revised effective date.

Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
